Stern: An LA judge blasted Mel B and Stephen Belafonte for 'living beyond their means' during their spousal support hearing and ordered them to keep to a budget of $51k a month expenses
Addressing the pair, the judge said: 'In particular, the court notes that while the baseline is the marital standard of living status quo, where, as here, the parties lived beyond their means, the Court ought not to aspire necessarily to reproduce that standard of living… for the parties'
'The Court notes a preliminary baseline figure the four year average of Ebersbacher's estimates of the parties' unallocated 'personal living expenses… this is $51,000 a month.
'This is at substantial variance with both parties' income and expense declarations, that is, both parties claim far more in monthly expenses.'
The judge also noted that the couple had lived a 'high upper class life' in the top '.1%' which was more expensive than their finances allowed.
The 14-page court document, reveals that Mel and Stephen have accused one another of fleeing with 'hundreds of thousands, if not millions, of community property dollars.'
The court found that Mel's income available for support was not less than $175,000 per month, with her claiming $5k for childcare with no explanation as one of her expenses and around $9k a month for food.
The judge added that he did not understand why neither of them reduced their monthly expenses by living in their former marital home in West Hollywood until it is sold.
Income: The court found that Mel's income available for support was not less than $175,000 per month, with her role on America's Got Talent contributing hugely
He also stated that both parties have a habitual inability to pay their taxes on time and are still 'saddled with unpaid taxes for 2016.'
Mel had told the court she objected to paying spousal support due to her domestic violence allegations against Belafonte, saying a victim should not be ordered to support her abuser.
However, the court ordered her to pay temporary spousal support totalling $40,000-a-month to her estranged husband.
He claims to have been Mel's business manager and says he is currently working har on a new LA restaurant which is yet to yield him a salary.
But this is only temporary and could change after a 15-day trial to determine if Mel's claims are true – he categorically denies the claims.
The support was back dated to May 12, 2017, and she also instructed to pay him $100,000 in legal fees and $40,000 in forensic accounting fees.
Costly: Mel B has been ordered to pay estranged husband Stephen Belafonte a reported $40,000 a month, despite squandering the bulk of her multi-million pound fortune during their 10-year marriage
